Services Description

AQualiT Med Courier provides specialized, time-sensitive courier and logistics services for the healthcare industry. Our Services include the transportation of medical specimens, pharmaceuticals, records, and supplies (“Materials”).

By using our Services, you represent and warrant that you are authorized to ship the Materials and that all descriptions and documentation provided are accurate and complete.

User Account and Security

To access certain features of the Site or Services, you may be required to register for an account.

Account Responsibilities

You agree to:

• Provide accurate, current, and complete information during the registration process

• Maintain and promptly update your account information

• Maintain the security of your password and accept all risks of unauthorized access

• Notify us immediately of any unauthorized use of your account

You are solely responsible for all activities that occur under your account.

Acceptable Use

Prohibited Activities

• Use the Services to ship prohibited items including hazardous materials, illegal substances, or improperly packaged items

• Provide false, inaccurate, or misleading information when scheduling a pickup or delivery

Shipping Terms and Liabilities

Shipper Responsibilities

You, the shipper, are solely responsible for:

• Ensuring the accuracy of all provided information including pickup and delivery addresses

• Properly packaging, labeling, and documenting all Materials

• Complying with all applicable laws and regulations including HIPAA, DOT, and IATA where applicable

• Declaring the accurate nature of the Materials and ensuring they are safe for transport

Limitation of Liability

AQualiT Med Courier’s liability for loss, damage, or delay is strictly limited.

In no event shall our liability exceed the lesser of:

• The amount of the shipping fee for the specific shipment

• One hundred dollars ($100.00)

We shall not be liable for indirect, incidental, special, consequential, or punitive damages including lost profits or revenue.

Force Majeure

AQualiT Med Courier shall not be liable for any delay or failure in performance resulting from causes beyond its reasonable control including but not limited to:

• Acts of God

• War or terrorism

• Severe weather

• Traffic conditions

• Government restrictions

Intellectual Property

The Site and its original content, features, and functionality including text, graphics, logos, images, and software are the exclusive property of AQualiT Med Courier and its licensors.

The Site is protected by copyright, trademark, and other intellectual property laws in the United States and internationally.

Our trademarks and branding may not be used in connection with any product or service without the prior written consent of AQualiT Med Courier.

Termination

We may terminate or suspend your account and access to the Site or Services immediately, without prior notice or liability, for any reason including violation of these Terms.

Upon termination, your right to use the Site and Services will cease immediately.

Disclaimer of Warranties

YOUR USE OF THE SITE AND SERVICES IS AT YOUR SOLE RISK.

THE SITE AND SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS.

AQUALIT MED COURIER DISCLAIMS ALL WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:

• IMPLIED WARRANTIES OF MERCHANTABILITY

• FITNESS FOR A PARTICULAR PURPOSE

• NON-INFRINGEMENT

Governing Law and Dispute Resolution

These Terms shall be governed and construed in accordance with the laws of the State of Florida without regard to conflict of law provisions.

Any dispute arising from these Terms or the use of the Services shall be resolved through final and binding arbitration in Jacksonville, Florida in accordance with the rules of the American Arbitration Association.

Changes to Terms

We reserve the right to modify or replace these Terms at our sole discretion at any time.

If a revision is considered material, we will provide at least 30 days notice prior to the updated terms taking effect.

By continuing to use the Site or Services after updates become effective, you agree to be bound by the revised Terms.
